A.2 Number of Workers Needed The number of workers needed represents the estimated shortage of domestic workers, and therefore the number of foreign workers the Employer anticipates will be needed. The Employer will hire all able, willing, and qualified domestic workers through the 50% point of the contract period and therefore the number of foreign workers hired could be substantially fewer than listed. The hours listed in block A.6 represent the normal work schedule. Due to the nature of these crops, weather, and the requirement to send the fruit to market when fresh, it is the prevailing practice to work substantially more, less, or different hours than those listed, sometimes for extended periods of time. When the number of hours for a week exceeds the number listed in section A.6, the worker may be offered, but not required, to work more hours. Workers may be required to work some evening or night shifts. Example Night shift: Monday through Friday from 8pm -2:30am and Saturday 8pm – 1:30am Workers may be offered to work on Sundays or federal holidays depending on field conditions, weather, and crop maturity; however, they will not be required to work more than the hours specified on the work order. At the employer’s discretion, it may release workers for a period of time, as determined by the employer. During this time, workers may travel home at the worker’s cost. The employer will provide workers with a specific time frame for the break. Any leave by the worker outside of this authorized break period will be considered an absence. This is regular, full-time work for a temporary period of time requiring the worker to be available for work on a daily basis. Excessive tardiness and/or absences will not be tolerated and will result in disciplinary action, in accordance with Kyle Mathison Orchards, Inc. policies in its handbook. SCHEDULING CHANGES. Workers should expect occasional periods of little or no work because of weather, crop, or other conditions beyond the employer’s control. These periods may occur anytime throughout the season. Workers may be assigned a variety of duties in any given day and different tasks on different days. Workers must be able to perform all duties within this job description in what can be considered a safe manner adhering to all established orchard safety guidelines, practices, and procedures. Must wear all required and assigned personal protective equipment at all times when required to do so. Worker must wear proper clothing and footwear depending on the season. All footwear must be closed-toed and durable due to safety precautions. The Employer or designated worker will provide instructions and general supervision. Workers will be expected to conform to the specific instructions given for each day’s work. Workers will be required to attend an orientation on workplace rules, policies, and safety information. All work sites covered by this clearance order and all facilities of the employer are drug free workplaces. Workers must not report for work, enter employer’s property, or perform service while under the influence of or having used alcohol, marijuana, or illegal controlled substances. Workers must not report for work or perform service while under the influence of or impaired by prescription drugs, medications, marijuana, alcohol, or other substances that may in any way adversely affect their alertness, coordination, reaction response or safety. Employer-paid post-hire upon suspicion and post- accident drug testing required. Individuals who are not employed by the Employer will not be permitted in or adjacent to the work site. No non-working children may be present at or adjacent to work sites or left in vehicles during the workday. Workers arriving at work with non-working children or other non-workers will be sent home. Workers who are eligible for Employer provided housing will have employer arranged transportation from the housing to the worksite. See Addendum C

Special Requirements:  Workers will engage in moderately complex tasks, requiring judgment and fostering familiarity with the employer’s methods. They operate under close supervision, following specific instructions for tasks and expected outcomes. Job specifications can change from time to time during the season due to crop or market conditions, even on the same crop. Adherence to daily instructions is crucial, with supervision provided by the farm owner or designated supervisor. Work may occur in temperatures below freezing and above one hundred degrees Fahrenheit. Workers will be given the opportunity to operate mechanized, energized, and/or mobile equipment and machinery only after having been qualified and/or trained by employer trainers. Lifting or loading up to 60lbs is expected, necessitating physical strength and endurance for repetitive farm labor processes throughout the workday. See Addendum C
